Pesaro, August 5, 2026 – She was 15 years old, aspired to a modeling career and had already attended courses and castings. Then the accident: she fell off the scooter, ended up on the asphalt, and was hit by a car that dragged her for about 37 meters. Almost five years later, the Pesaro Court ruled that the responsibility is to be divided exactly in half: 50 percent to the girl and 50 percent to the driver.
The young woman, left with a permanent disability of 38 percent, was awarded, after the reduction related to her share of responsibility, compensation of over 155 thousand euros out of the 873 thousand requested. The judge rejected the claim of over 400 thousand euros related to the possible modeling career: courses and castings, according to the ruling, are not enough to prove that this path would have had a concrete professional outcome. The accident dates back to the evening of September 7, 2021, around 9:20 p.m., on Strada Molino Mosca, in Pesaro.

The events five years ago
The girl was riding a Malaguti Phantom when she lost control of the vehicle and fell, ending up in the opposite lane. Investigations indicated that the girl sharply applied the front brake, causing the front wheel to lock, the loss of vehicle stability, and the consequent slide into the opposite lane. The scooter was not hit by the Toyota Yaris coming from the opposite direction. The fifteen-year-old, already on the ground and separated from the scooter, was the one hit.
For the Court, however, this is not enough to completely absolve the driver of responsibility. The woman had seen the scooter swerve and the girl fall and did not react quickly enough. According to the judge, a more timely brake could have at least reduced the dragging and therefore the consequences of the collision.
Surgical interventions, rehabilitation, and a long course of treatment
The girl underwent several surgical interventions, rehabilitation, and a very long course of treatment. Compensation was also awarded to the mother, considering the long period spent alongside her only cohabiting daughter during hospitalizations, surgeries, and rehabilitation, and the strong impact the accident had on family life. The amount was set at 80 thousand euros and then halved due to the responsibility attributed to the girl: the mother is therefore entitled to 40 thousand euros.
