Reggio Emilia, September 2, 2026 – In the long-standing clash between the activists of the committee defending the so-called “Bosco Ospizio” and Conad Centro Nord, the former score a point, more formal than substantial in the context of the case, but still important, in their favor. The complaint, dating back to February 2025, filed by the cooperative giant against the Reggio botanist Ugo Pellini, who has always been at the forefront in defending the city’s green areas, and 8 other suspects, has in fact been dismissed by the Gip of Reggio.

The complaint for “invasion of others’ land”
The subject of the company’s action was a criminal complaint for “invasion of others’ land with the intent to occupy it, damage and private violence”; facts which, however, do not exist. This was announced by lawyer Raffaella Pellini, legal counsel for the well-known botanical expert, recalling that already at the time “the competent Public Prosecutor requested its dismissal” by virtue of the fact that “the suspects were peacefully standing in the place where the gardener was mowing and the mowing stopped only because the gardener considered it dangerous to operate with more people around.”
Additionally, the Public Prosecutor excluded any hypothesis of damage as the persons informed of the facts “excluded – when heard at the time – this conduct by the suspects.”
The dismissal ordered by the Gip of Reggio
With a ruling on June 11, the Gip of Reggio accepted the requests of the investigating judiciary, thus ordering the dismissal of the proceedings “because the fact does not exist,” despite Conad’s opposition.

According to what emerges from this provision, lawyer Pellini always specifies: “The necessary elements to configure the alleged crimes were not found. In particular, the suspects would have entered the area through a permitted passage, without engaging in conduct attributable to damage. Furthermore, no behavior suitable to prevent or hinder the mowing work emerged, nor are there any alleged threats aimed at preventing the execution of the work with the excavator.”
“No findings from a criminal perspective”
“The provision – concludes Ugo Pellini’s defender entering into the merits of the same – restores correctness to a case in which my client, together with the other 8 suspects, was called to answer for facts that, following the investigations by the Prosecutor’s Office and the evaluation of the Gip, found no confirmation in reality from a criminal perspective. It is significant that it was the same Public Prosecutor who requested the dismissal and that the Gip ordered it, considering that the fact does not exist.”
