According to what the woman reconstructed, the payment through the MooneyGo app was not completed on time due to a temporary data network malfunction. The transaction, amounting to 3.05 euros, was made just three minutes after the auxiliary’s check, as soon as the connection became available again. “This proves my good faith and willingness to comply – De Vero claims –. The delay was not due to negligence, but to a technical problem.” Hence the request to Aset to cancel the notice in self-defense and, after the rejection, at least to refund the paid fee.

The company: “You can also pay with coins or credit cards”

The company’s response was however clear. Aset reminded that in the managed areas it is possible to pay not only through applications, but also with coins and credit cards. In case of a system malfunction, therefore, it would be up to the driver to use another one. As for the 3.05 euros, the company specified that it is not obliged to refund. A position that De Vero considers “pretextual and lacking fairness”. “If the company promotes digitalization – she notes – it cannot then place all the technical risks related to network failures entirely on the user.”

Also the proposed solution, that is waiting in the car for the connection to be restored, would have been impractical, she emphasizes, with temperatures close to 40 degrees. Then there is the issue of the amount already paid. According to the woman, withholding the 3.05 euros without canceling the sanction would constitute “unjust enrichment”. Aset replies that, since it is a reduced amount notice, it is not possible to appeal: to challenge it one would have to wait for the report, increased by notification costs. De Vero decided to pay, but also addressed a formal protest to the president of Aset, Mattioli.
