Ancona, July 27, 2026 –The two kindergarten teachers from Polverigi invoked their right to remain silent during the guarantee interrogation before the Ancona judge today. The two women, aged 60 and 53, residing in Offagna and Falconara, long-serving at the private school, under house arrest since July 24 on charges of mistreatment and child abandonment, arrived at the court visibly shaken and distressed by the incident that involved them.
Request for revocation of house arrest
The defenders — lawyer Italo D’Angelo for the 53-year-old, lawyer Francesco Napolitano for the 60-year-old — requested the judge to revoke the house arrest and, alternatively, to reduce the measure. The decision is expected in the coming days. The silence in the courtroom has a specific reason: the evidence that led the Prosecutor’s Office to activate the red code, namely the videos and audios collected by the carabinieri during the investigations, were not included in the file and therefore the defense could not examine them.
Examination of the evidence against them
“My client exercised her right to remain silent on my advice – explained D’Angelo –: I could not view the videos nor listen to the recordings because they were not attached to the file, and therefore I could not exercise my right to defense. I asked the magistrate that, given this unusual situation, a less severe measure be applied.” Now the documents will be sent to the public prosecutor and only then will the lawyers be able to examine the evidence against them. The absence of that material from the file is significant, because it is precisely on the videos and audios collected during the investigations that the precautionary custody order issued at the request of the Prosecutor’s Office is based. The red code in this case provided for the arrest measure, since the alleged crime is mistreatment of defenseless victims.
The investigations
The investigative activity started after a report from a former colleague, who first entrusted her accusations to two anonymous letters and then formalized them with a complaint. The investigation, which covers only the month of June, contests a total of four episodes — “single episodes,” as D’Angelo himself defines them — each with a plausible explanation offered by the accused: from the darkness in the bathrooms that remained unconfirmed to the shoes taken off a child because he allegedly kicked his classmates. Another element casting shadows on the case is that no family, to date, has filed a complaint.
