Macerata, August 27, 2026 – A will under accusation: the judge locks down the inheritance of Romano Sarnari, who died in Treia in 2021 at the age of 93, well known in the province for having been long-time municipal secretary of Montecassiano, Montelupone, Sarnano, and Visso.

The Macerata court ordered the seizure of houses and assets and froze up to 200,000 euros. Sarnari had named Gianfranca Scarponi, niece of his late wife Giancarla, as universal heir, but two other nephews, Luca Ottolina and Giuseppe Sarnari, assisted by lawyers Federico Valori, Giulia Garofolo, and Benedetta Tommasoni, had contested those last wishes.
Gifts worth hundreds of thousands of euros
In this story, hundreds of thousands of euros in “gifts” appear, postal savings bonds for 65,000 euros and a pension of 3,850 euros per month followed, according to the investigations cited by the Guardia di Finanza, by “systematic cash withdrawals”. Regarding the holographic will, dated June 14, 2021, the excluded nephews raised the hypothesis of incapacity exploitation and filed a criminal complaint against the woman, defended by lawyers Giancarlo Giulianelli and Piero Paciaroni.
The judge has safeguarded the estate
The preliminary hearing is scheduled for next October 7. The criminal proceedings will follow their course, but meanwhile civil judge Quirino Caturano, following a precautionary request made by the Valori law firm, with an order filed last Monday, deemed that there were sufficient elements to safeguard the estate.
Surveillance was carried out
The investigations were conducted by the Economic and Financial Police Unit of the Guardia di Finanza of Macerata, commanded by Lieutenant Colonel Francesco Mirarchi. The Guardia di Finanza carried out banking checks on the financial accounts of Sarnari and the woman, including a joint account, technical investigations on phones, and the examination of some individuals. Analyses and medical records were acquired and surveillance was carried out. The will was also subjected to a handwriting expert examination, comparing it with other documents to verify the handwriting and signature’s attribution to the deceased.
The man’s condition at the time of the will
As reported by Judge Caturano, on August 23, 2021, just over two months after the date of the will, Sarnari was urgently hospitalized in a “drowsy” and “semi-conscious” state. A nurse who intervened at his home described him as “bedridden and unconscious.” He also suffered from chronic myelodysplastic syndrome and had stopped blood transfusions since the previous January. In light of these conditions, the judge considered it “not unlikely” that at the time of the will he was already in a condition of weakened capacity to self-determine.
Then there is the money
In March 2020, two postal savings bonds for 65,000 euros were liquidated in favor of the niece. The account in the woman’s name also shows transactions of about 81,000 euros between 2019 and 2021. Sarnari received a pension of about 3,850 euros monthly and, according to the Guardia di Finanza report cited in the order, after the credits there were “systematic cash withdrawals,” as well as the issuance of checks for about 110,000 euros. The nephews had initially requested a precautionary seizure up to 861,922 euros, but for some of the old gifts the judge considers the restitution claim time-barred.
However, the 65,000 euros from the bonds and the pensions collected between 2019 and 2021 remain under scrutiny: out of 126,922 euros, the court estimates that no more than 25,000 euros could have been used to support the elderly man, identifying about 100,000 euros as the residual amount. Also seized is a 172 square meter apartment in Treia, two other units in the same building, and the inventoried movable assets. Regarding the woman’s assets and financial resources, a precautionary seizure up to 200,000 euros was authorized. A custodian will manage the estate and collect any rents into a restricted account pending the decision on the merits.
