The man’s condition at the time of the will

As reported by Judge Caturano, on August 23, 2021, just over two months after the date of the will, Sarnari was urgently hospitalized in a “drowsy” and “semi-conscious” state. A nurse who intervened at his home described him as “bedridden and unconscious.” He also suffered from chronic myelodysplastic syndrome and had stopped blood transfusions since the previous January. In light of these conditions, the judge considered it “not unlikely” that at the time of the will he was already in a condition of weakened capacity to self-determine.

In March 2020, two postal savings bonds for 65,000 euros were liquidated in favor of the niece. The account in the woman’s name also shows transactions of about 81,000 euros between 2019 and 2021. Sarnari received a pension of about 3,850 euros monthly and, according to the Guardia di Finanza report cited in the order, after the credits there were “systematic cash withdrawals,” as well as the issuance of checks for about 110,000 euros. The nephews had initially requested a precautionary seizure up to 861,922 euros, but for some of the old gifts the judge considers the restitution claim time-barred.

However, the 65,000 euros from the bonds and the pensions collected between 2019 and 2021 remain under scrutiny: out of 126,922 euros, the court estimates that no more than 25,000 euros could have been used to support the elderly man, identifying about 100,000 euros as the residual amount. Also seized is a 172 square meter apartment in Treia, two other units in the same building, and the inventoried movable assets. Regarding the woman’s assets and financial resources, a precautionary seizure up to 200,000 euros was authorized. A custodian will manage the estate and collect any rents into a restricted account pending the decision on the merits.
