Rome, August 8, 2026 – From the B license at 17 years old to more proportionate fines. There are 15 main proposals for revising the Highway Code, which the Ministry of Infrastructure and Transport has sent to over a hundred operators and associations. Regarding the new code, the goal is to “arrive at a text that is as close as possible to the needs of motorists, with traffic safety as a priority,” states the ministry.
The news under study
The first point under study provides for mandatory helmet and badge for super-bikes, cycles with propulsion often used by riders. Then there are news concerning motorcyclists: they will be able to use the emergency lane on highways in case of slowdowns. A halving of fines for two-wheelers parked illegally is also planned.
“With the new Highway Code, it is intended to introduce the obligation for municipalities to join the Cude platform (European parking badge for people with disabilities), providing, in case of non-compliance, the impossibility of using devices for remote verification of violations related to reserved parking and ZTL,” explains a note from the Ministry of Transport.
Also under study is the introduction of the rule of overtaking on the right on highways: it is intended to apply parallel lane circulation on three-lane highways and expressways, which would allow overtaking on the right.
B license at 17 years old
European directives have lowered the age to obtain B license at 17 years old. Italy has time to implement them by the end of 2027, which is why changes to the highway code proposed by the Ministry of Transport allow accompanied driving at 16 years old for holders of A1 and B1 licenses. They also provide that heavy vehicles, without trailers, requiring C1 and C licenses can be driven at 17 years old with B and CQC licenses (driver qualification card).
Crackdown on those driving without insurance
Hard line against those driving without insurance. Among the news under study by the MIT, strengthened checks through the Motorization databases and the introduction of a digital driving ban. In case of failure to regularize, at the first roadside check seizure can be applied directly. Also under study is a doubling of the main fines committed by an uninsured vehicle, an increase in point deduction (from 5 to 7), and a short suspension of the license up to 15 days.

More proportionate fines and resources for road safety
Other proposals provide for simpler and more proportionate fines to the actual severity of violations, reduction of sanction increases in case of late payment, and recovery of unpaid fines from foreigners within five years after the violation. In particular, the possibility of enforced collection will be provided against any driver found circulating in Italy with the vehicle with which the infraction was committed.
As part of the changes to fines, the Ministry of Transport is working to revise speed limit sanctions based on progressivity criteria. In the revision proposal, violations of higher limits are punished more severely, considering the greater danger. On highways, one hypothesis provides for 10 euros more for each kilometer over the limit: with a limit of 130 km/h, those driving at 140 km/h will pay 100 euros, those driving at 170 (exceeding the limit by 40 km/h) will have a fine of 400 euros. On roads with a limit of 50 or 30, fines would be 5 euros per km/h over.
There could also be an enhancement of appeals to the prefect and a simpler regulation of self-defense to request the cancellation of incorrect tickets, with greater proportionality in cases of small payment errors. Less waiting for those who receive a fine, with a reduction from 90 to 30 days of the notification deadline for tickets related to remote checks. Fines for violations might no longer be automatically updated for inflation: the possibility to increase fines only in case of inflation increases above 5% is planned.
Finally, more resources from fines must go directly to road safety. The proposal under study by the MIT provides for 70% of the proceeds to the road owner entity, to be reinvested in safety interventions, and 30% to the enforcing entity for control and notification activities.
