Modena, August 3, 2026 – The Tar Emilia-Romagna suspends the dismissal order of a teacher from Modena excluded from the ranking of the competition after she did not accept the assigned location within the deadline. A position lost due to a non-received e-mail and consequently a nomination never accepted in time.
The story: the teacher did not have timely knowledge of the communication and was notified, during the night between July 22 and 23, of the automatic registration of a “withdrawal” never actually expressed, with consequent removal from the ranking.
The appeal to the Tar and the decision of the administrative court
Assisted by the Cisl Scuola lawyer, Veronica Pepoli, the teacher appealed to the Tar, highlighting how it is unacceptable “to set such a tight deadline with irreversible effects without the certainty that the person concerned has actually received and known the act. The use of an uncertified channel for such important communications appears “inadequate and harmful to the principles of correctness and transparency of administrative action.”
The Court found the reasons of the appellant well-founded and suspended the effects of the measure, allowing the immediate protection of the teacher’s employment position, pending the final decision.

This decision confirms what we have been saying for a long time: a change of pace is needed in the management of appointments. It is essential to use official and traceable channels, such as Pec or equivalent systems, to avoid errors and injustices”
