The story

The story dates back to 2012. The woman, already suffering from several pathologies and affected by a **severe cerebral stroke**, had been hospitalized on August 4 in the intensive care unit of the Ospedali Riuniti di Foggia. After about a month of hospitalization, on August 29, she was transferred to the rehabilitation center in the province of Rimini. It was upon arrival at the Romagna facility that a very worrying clinical picture emerged, linked to the presence of the antibiotic-resistant bacterium **Klebsiella Pneumoniae**, a microorganism often associated with **hospital-acquired infections**. According to what was reconstructed in the trial, the patient tested positive for this bacterium already during her hospitalization in Foggia.

The consultants appointed by the Court highlighted that the woman had not undergone the checks required upon admission to the ward and that, once the presence of the bacterium was discovered, **adequate monitoring would not have been carried out to verify the evolution of the situation**. When the woman arrived at the Rimini facility, doctors immediately performed new tests. Within a few days, it emerged that the bacterium had already entered her bloodstream and caused **severe sepsis**, an uncontrolled response of the body to an infection that can lead to damage to vital organs. Despite treatment and targeted antibiotic therapy, the patient died on September 29, 2012.

Justice

In the first instance, the Court of Foggia had rejected the compensation claim made by the family members. However, the **Bari Court of Appeal** partially overturned that decision after a new technical consultation. The judges held that it is not possible to state with certainty that the omissions of the healthcare professionals directly caused the woman’s death, also because the patient was already in very serious condition due to the numerous pathologies she suffered from. Nevertheless, **the Court recognized that these omissions caused the patient to lose a concrete chance of surviving longer** or having a different outcome of the illness. For this reason, the Court ordered the Apulian company to pay over 104 thousand euros to the woman’s heirs. Conversely, the ruling indicates that the Rimini facility was not held responsible. Indeed, the consultants appointed by the Court wrote that the conduct of the healthcare professionals at the Rimini facility “must be considered irreproachable”.
